Terms of Use

1. Parties and acceptance

These Terms of Use ("Terms") govern access to the Karmn service and form an agreement between you ("Customer", "you") and AX Creativ S.R.L., CUI 49475584, VAT RO49554432, registered office: Jud. Iași, Mun. Iași, Șos. Nicolina, nr. 189, bir. 2, Et. 2, Romania ("Provider", "we").

By using karmn.services, demo.karmn.services, app.karmn.services, or submitting a request on the landing page, you confirm that you have read the Terms and the Privacy Policy and accept them. If you act for an organisation, you confirm authority to bind it to these Terms.

2. Service description

Karmn is a cloud CRM and related tools for auto repair shops, detailing studios, and car washes.

• karmn.services — marketing site and contact forms.
• demo.karmn.services — demonstration environment to explore features.
• app.karmn.services — production application, accounts, and free/paid plans.

Features and limits depend on the selected plan and may change with reasonable notice, without reducing essential obligations for an already paid period without a right to cancel or a proportionate credit — within applicable law.

3. Registration and account

For the app (and demo where required) you create an account and agree to provide accurate information, keep credentials confidential, and notify us promptly of any compromise.

You are responsible for activity under your account. We may suspend access if we suspect a Terms breach or a security risk.

4. Plans and payment

Current pricing is shown on the landing and/or in the app. Payment is made by the methods offered in the service. Applicable taxes (including VAT) are shown separately or included as displayed at checkout.

Subscriptions renew for the selected period until cancelled. On late payment we may restrict paid features after notice.

Refunds follow the rules stated at purchase and mandatory consumer/commercial law. For B2B, paid periods are generally non-refundable except for material unavailability caused by us.

5. Acceptable use

You agree to use the service lawfully and not to:

• infringe third-party rights or upload unlawful content;
• attempt unauthorised access, disrupt infrastructure, or bypass security;
• use the service for spam or harmful activity;
• share access in breach of the plan or these Terms;
• copy, resell, or build a competing product from non-public parts of the service.

6. Customer data and personal data

You retain rights to data you enter into the service ("Customer Data"). You grant us a licence to process that data solely to provide the service, support, and perform the contract.

If Customer Data includes personal data of third parties (e.g. shop customers), you are the controller and we are the processor. You warrant you have a legal basis to provide such data to us. Details are in the Privacy Policy; a separate DPA is available on request.

7. Intellectual property

The service, software, design, trademarks, and Karmn content belong to AX Creativ S.R.L. or its licensors. You receive a limited, non-exclusive, non-transferable right to use the service during the contract term under your plan. Reverse engineering is prohibited except where mandatory law allows.

8. Demo environment

The demo is provided "as is" for product evaluation. Demo data may be reset periodically; do not use the demo for real production or unnecessary personal data. Demo access may be limited or ended without compensation.

9. Availability and support

We aim for reasonable availability but do not guarantee 100% uptime. Planned maintenance and outages may occur. Support is via support@karmn.services and channels listed on the site, during our usual business hours unless otherwise agreed in writing.

10. Disclaimer and limitation of liability

The service is provided "as is" and "as available" to the extent permitted by law. We do not warrant that it will meet all your business goals or replace professional advice from a mechanic, accountant, or lawyer.

To the maximum extent permitted by applicable law, AX Creativ S.R.L.'s aggregate liability for claims related to the service in the preceding 12 months is limited to the fees you actually paid us for the service in those 12 months (or EUR 100 if no fees were paid). We are not liable for indirect loss, lost profits, data loss (except processor duties under the GDPR where required by law), or business interruption, unless mandatory law provides otherwise.

11. Term and termination

The agreement starts when you accept the Terms and continues until the account is closed or the subscription ends. You may stop using the service and delete or request deletion of the account. We may terminate or suspend access for material breach, non-payment, or by law, with notice where reasonable.

After termination we end access; export of Customer Data may be available for a reasonable period if the feature exists or on request, unless law or contract requires otherwise. IP, liability, data, and governing-law clauses survive.

12. Changes to the Terms

We may update these Terms. The current version is published on the site with the date. Material changes will be communicated prominently. Continued use after changes take effect constitutes acceptance unless law requires separate consent.

13. Governing law and disputes

These Terms are governed by Romanian law. Parties will seek to resolve disputes by negotiation; failing that, the competent courts of Romania at the Provider's registered office, unless mandatory rules (including consumer protection) require otherwise.
